Summary Of Practice

Nick was called to the Bar in 2006. He has a particular interest in Employment, Personal Injury and Contract Law: -

Employment

Nick undertook a number of cases for the Free Representation Unit, both prior to and during Pupillage, which included unfair dismissal and discrimination claims. Nick won favourable outcomes for all clients either through settlement or final judgment.

Since becoming a tenant in October 2007 Nick has frequently represented both employers and employees in Tribunals. He has undertaken claims of unfair dismissal, wrongful dismissal, discrimination, harassment, victimisation, TUPE, breach of contract and unlawful deductions from wages.

Nick regularly attends Case Management Discussions, Pre-Hearing reviews and final hearings on all these matters and provides advice on liability and remedy throughout the course of a claim.

He also has attended Judicial Mediations and has represented clients during their internal disciplinary process.

  • MacDonald v Royal Mail (For the Respondent in a 3 day race discrimination final hearing)
  • Tucker v Rentokil (For the Respondent in an unfair dismissal and disability discrimination claim, final hearing)
  • Penbethy v Access Scaffolding (For the Claimant in an unfair dismissal claim)
  • Kakaria v Mitie Security (For the Respondent in a 4 day case, which involved unfair dismissal, sex discrimination and unlawful deduction from wages)
  • Khan v Mitie Security and Reliance Security (For the First Respondent in a claim for equal pay and sex discrimination with TUPE issues).

Personal Injury

During the first six months of his Pupillage Nick’s Pupil Masters were two of Chambers leading Clinical Negligence and Personal injury practitioners Richard Furniss and Charles Utley.  Throughout this time he assisted with a wide variety of high value cases and subsequently developed and maintains a strong interest in these areas.

As a pupil and junior tenant Nick cut his teeth on numerous road traffic small claims and now undertakes a variety of Fast Track work for both Claimants and Defendants in relation to road traffic accidents, highway claims and ‘slippers and trippers’ amongst others.

Nick is happy to take on cases on a CFA basis.


Contract

Nick advises and has drafted pleadings and defences in a wide range of commercial matters including Sales of Goods, poor workmanship and general breach of contract. He has regularly attended court at both interim and final hearings and has appeared at appeal before Circuit Judges. Occasionally his practice has taken him to the High Court.
