ASB Injunctions: Breach procedure and sentencing guidelines

Niamh O’Brien and Louise Whittington present the next housing webinar in our series exploring anti-social behaviour injunctions. In this episode, Niamh outlines the  procedure that must be followed in relation to applications for committal for contempt of court for breach of an ASB order. She also reviews key decisions concerning the operation of  CPR Part 81 since its introduction in October 2020. Louise then goes on to cover the new approach to sentencing for breach set out in the Court of Appeal 's decision of Lovett v Wigan Borough Council.
