Warrants for Possession II

Cardiff City Council v Lee (Flowers) [2016] EWCA Civ 1034

Following the decision in Cardiff City v Lee (Flowers) the Civil Procedure Rules Committee has been considering Form N325 (Request for warrant of possession of land). Pending a final decision from the Committee, HMCTS has introduced two new forms which must be used:
1. Form N325A (Request for warrant for possession of land following a suspended possession order)

2. Form N445 (Request for reissue of warrant)

Each of these forms has a section for providing details of the alleged breach of suspension.

Practitioners are advised to make use of the forms from now on.
