Personal Injury and Clinical Negligence Law

Lisa has considerable experience in acting in the most serious of personal injury claims. She regularly acts for claimants in cases involving, cerebral palsy, spinal injury, catastrophic brain injury, psychiatric injury and amputation. She is also instructed for defendants in similar cases. She has acted in numerous multi-million-pound settlements over the years.  

In personal injury, a very high percentage of cases settle out of court. Many of these high value cases regularly involve children or incapax adults. The details of these cases are confidential. It would not be appropriate to list the names of the cases or details of those settlements. The following are examples of reported cases in which Lisa has been involved in the past.

Noteable Cases

  • Moore v Campbell [September 2017] [Ex tempore judgment of Lord Woolman (Court of Session)] Senior counsel for the pursuer. RTA in which there was head on collision on the wrong side of the road in which the defence claimed that oil on the road had caused loss of control. Judgement in favour of the pursuer.  
  • KR v Lanarkshire Health Board [2016] CSOH 133: Junior Counsel for the Pursuer: Clinical negligence case in which the child of the Pursuer had been diagnosed with cerebral palsy. Pursuer successful on the merits and reclaiming motion made by the defence, ultimately dropped.
  • CD v Lanarkshire Health Board [2017] CSIH 30; [2015] CSOH 142. Clinical negligence. Junior Counsel for the Pursuer at the trial at first instance and thereafter, at the reclaiming motion made by the defence. C’s birth was delayed by shoulder dystocia. He sustained a severe brachial plexus injury. The pursuer was successful in proving negligence at first instance. The defenders reclaimed, unsuccessfully.
  • Robin Donald and others v Ayrshire and Arran Health Board and others [2013] CSOH 23: Clinical negligence. Junior Counsel for the Pursuer. Pursuer’s wife died of DVT. The deceased’s GP was found to have been negligent. Successful outcome for pursuers.
  • D’s Parent and Guardian v Greater Glasgow Health Board 2011 SLT 1137. Clinical negligence. Junior Counsel for the Pursuer. Liability admitted. Commented on with approval in Helmot v Simon 2012 UKPC 5. Child suffered severe spinal injury at birth and was rendered tetraplegic, cognitively impaired and ventilator dependent. He required 24 hour waking care at home. Structured settlement. Periodic payment order approved by Court.

Arbitration

Lisa was made a Fellow of the Chartered Institute of Arbitrators in 2019. She acted as senior counsel for the defendants in an international arbitration, seated in Scotland in 2019.

Criminal Injuries Compensation

Lisa acted as Junior Counsel in a CICA claim for an adopted child of a claimant with severe cerebral palsy in which the Authority made an award of £7.9 million.

Fatal Accident Inquiries

Lisa acted for the family in relation to the death of a young girl who received an overdose of radiotherapy.

Public Inquiries

Lisa is currently acting for the Chief Constable of Police Scotland, in the Public Inquiry into the death of Sheku Bayoh.
