Recent Case

  • Father v Mother & Anor [2024] EWHC 2578 (Fam)
In this case, William Tyler KC and our member Andlib Mohsin, instructed by Sian Churchill of Crane & Staples, appeared for the mother and successfully defended an appeal in the High Court before Mrs Justice Lieven.
Andlib Mohsin represented the mother in the County Court, where the father’s application for a change of residence to his care was refused. The father appealed. The High Court dismissed the appeal on all grounds, confirming that the child would remain in the mother’s care. In addition to summarising the principles in relation to appeals that challenge a trial judge’s conclusions, the case guides the court’s approach to allegations of ‘parental alienation‘. It reiterates the importance of balancing harm and benefits when considering a change of residence [39-40]
