Court of Appeal hands down decision in Rice v Wicked Vision

Judgment has been handed down in Rice v Wicked Vision (Protect intervening) and Barton Turns Developments Ltd  v Treadwell [2025] EWCA Civ 1466.

Nicholas Bidnell-Edwards acted for the Appellant in the Court of Appeal. In a significant judgment for all whistleblowing claims for dismissal brought by employees, the Court of Appeal has held

i) that it is bound by the decision in Timis v. Osipov [2019] ICR 655 to allow employees to pursue claims of dismissal against their employers as detriments under Section 47B ERA 1996; and

ii) that if it had not been bound by the prior decision in Timis v Osipov [2019] ICR 655 then it would have found it was not possible for employees to bring a claim of dismissal as a detriment under Section 47B ERA 1996.

The Court of Appeal went on to hold that the various conflicting decisions can only be resolved by Parliament, or the Supreme Court.
