In Vale of Aylesbury Housing Trust Ltd. v Jason Richens [2020] EWHC 685 (Ch), Desmond Kilcoyne and Peter Jolley acted for the Respondent tenant successfully resisting an appeal by the landlord Housing Trust (represented by Jonathan Manning and Anneli Robins). The trial judge had accepted the Respondent’s case that he was granted a joint tenancy (with his grandfather) of the subject property and that, on the death of his grandfather, he was effectively immune to a claim for possession. Among other issues, the Court rejected arguments based on the Trust’s policy against granting inter-generational tenancies and their officer’s lack of authority to grant such tenancy.
