Gemma Farrington QC and Marcia Hyde appeared on behalf of the father in this appeal by the mother against findings that she had inflicted serious injuries upon her child.
Of note, the local authority argued that, if the Court of Appeal were to be persuaded that the finding that the mother was the perpetrator should be set aside, it would be open to them to substitute a finding that the injuries were inflicted by either the mother or the father.
Both mother and father contended that in those circumstances, the Court of Appeal would need to order a rehearing.
In the event, the appeal was dismissed and the Judge’s findings upheld.
