Harassment vs. Harassment: A Practical Comparison between the Equality Act and the Protection from Harassment Act

To conclude our Employment Webinar 2025 series, Iris Ferber KC and Max Gordon discuss the two very different types of “harassment” claim, when each might be used, and how to deploy them.

  • What if your client has been bullied and harassed, but not in connection with any protected characteristic?
  • What if your client needs the harassment to stop, more than they need to be compensated for it?
  • What if your client is an employer, and the person doing the harassing is a current (or former) employee?

The Protection from Harassment Act 1997 is very different from section 26 of the Equality Act 2010, and sometimes it can provide a solution where the Equality Act cannot.
