Robert Winspear acted (with Iain Quirk KC and Freddie Onslow of Essex Court) for the successful petitioner in Krishna v Gowrie and others [2023] EWHC 1538 (ch).
Krishna brought an unfair prejudice petition and a Part 7 claim against eight Respondents/Defendants. Following a 7-week trial, the Court found Krishna's interests had been unfairly prejudiced and a buy-out order was made. The Court also found that a shareholders' agreement had been procured by fraudulent misrepresentation which the Second Respondent had since sought to conceal by forging bank statements. There will now be a quantum trial in this matter to determine the value of Krishna's shareholding for the purposes of the buy-out.
