
Supreme Court Judgment re H-W
Following on from the Court of Appeal decision in re H-W, the Supreme Court have now decided on the appeal. At Supreme Court level, three members of Chambers appeared for the respondent Local Authority, Damian Woodward-Carlton QC, Sharan Bhachu and Katie Phillips, with Sharan Bhachu appearing at first instance and in the Court of Appeal.
This is an important decision relating to the proportionality of making final care orders and reiterating the approach to be taken when children are being removed from their parents. The judgment also considers the role of the appellate court in such appeals.
