This is an appeal heard by McFarlane P, Lewison LJ and Jackson LJ.
The case highlights once again, the importance of ensuring that the expert appointed in a case has the necessary expertise, and professional registration, to undertake the assessment being sought. It also reminds practitioners of good practice in terms of transparency with all parties to avoid future issues. The judges also helpfully summarise the law on experts in children proceedings – definition, admission, protected titles and professional regulation.
Finally the case also gives clear guidance for the correct way to litigate when issues arise with an expert’s qualifications.
