Stephen Willmer accepts instructions across the gamut (see below) of chancery and commercial practice in England and Wales. There is in his practice an emphasis on disputes concerning houses, flats or apartments and high street commercial premises, albeit the disputes arise for different reasons, personal and professional, and may be couched in different terms.

At one end of the spectrum are cases arising out of inheritances, at the other those of purely commercial concern and, in the middle, differences between neighbours or residential co-owners.  Underlaying all – or most – of which is his adjacent work in related areas such as those within the ambit of the Insolvency and Companies Court, the Property Tribunal and the Court of Protection.

Across the range of this work, there are often allegations of financial dishonesty (and worse).

Stephen likes to think that his advice is practical and that his representation in court is firm.  He is always keen to get under the skin of a problem and to consider it from all angles.

Property Law

In the field of property law, Stephen’s practice is very wide-ranging and involves and equally wide client base (including public interest and community benefit entities) often with an overlap of harassment allegations.

SAMPLE CASE TYPES:

  • Notice to complete disputes.
  • Claims concerning constructive trusts and proprietary estoppel (Tolata, likewise).
  • Disputes surrounding trustees, contentious probate and Inheritance Act claims.
  • Residential and commercial landlord and tenant cases (including Tribunal cases).
  • Trespass and boundary dispute claims.
  • Interpretation of leases.
  • Local authority later life care fee issues.
  • See also: Re. Hendry – a case on the 1975 Inheritance (Provision for Family & Dependants) Act, with a focus on claims being out-of-time (i.e. late).
  • Residential and commercial landlord and tenant cases (including Tribunal cases).
  • Interpretation of leases.
