Why is civil fraud like an elephant? Because it is easy enough to recognise, but much harder to define.
All litigation lawyers know that advancing a case of fraud is complex, engaging a variety of professional and procedural requirements. But what does that mean in practice?
Because of these uncertainties, many practitioners strive to avoid allegations of fraud – even when it would be in their client’s best interests to assert a cause of action involving dishonesty.
This series of talks aims to show how a good working knowledge of civil fraud can be deployed in a range of civil practice areas, in order to obtain procedural advantages and remedies which might not be available when dishonesty is not alleged.

Session 1

Iris Ferber KC and Alex Adamou
In this introductory session, Iris Ferber KC and Alex Adamou provide a general introduction to some of the key concepts of fraud:
- How do we define fraud?
- What causes of action does it involve?
- What are the procedural requirements?
- What are the advantages/ disadvantages of pleading fraud?

Session 2
Thursday 21 November, from 5pm
Angela Piears and Louise Whittington
Social housing fraud is a statutory creature; or is it? Angela Piears and Louise Whittington will explore what we mean by “social housing fraud”, the scope of the Prevention of Social Housing Fraud Act 2013, the statutory powers and remedies available to social landlords, and the types of housing fraud cases which are outside the remit of the Act.

Iris Ferber KC and Robert Winspear
This webinar provides an overview of the law relating to commercial fraud. Primarily, this will be an introduction to the area, with a focus on procedural requirements, recent caselaw and practical tips.

Thursday 23 January 2025, from 5pm
Paul Fuller and Andrew Carter
Andrew Carter and Paul Fuller review the law, together with some recent authorities, and discuss practical and tactical considerations in relation to property fraud; real, personal, legal and equitable.
Session 5
Thursday 20 February 2025, from 5pm
Stephen Willmer and Amy Stroud
Unusual among causes of action, the contentious probate claim is defined by the fact that the one person who ought to be able to hold the fraudster to account is dead. This seminar addresses the role fraud can play in the already fraught arena of challenging testamentary gifts. Stephen Willmer and Amy Stroud revisit basic principles, recent cases and explore practical advice for handling, or resisting, such claims.
